Terms and Conditions enabled in onepage checkout review but not showing in PayPal Express checkout review

I am not a programmer but have managed to sit behind this screen and search every forum until I figure out the task at hand to set up my magento store, at least to the best of my ability.  I can not seem to figure this one out though.  First I really want to disable onepage checkout and just use paypal express, most of our orders are $.99 song downloads and the extra information is just too time consuming for most customers to have to do in our store and then again in PayPal.  I have set up my terms and conditions, tested it with a 100% coupon voucher, gone through onepage checkout and the terms and conditions are there.  If I go through PayPal, as that is the only option to make payment except for the coupon voucher, the final checkout review does not have the terms and conditions.  It does still allow checkout and my download links are active.  I have a fresh install of 1.5.0.1 and am using mHitech custom theme.  I have already tried taking the paypal folder from app/design/frontend/base/default/template/paypal and putting it into mHitech themes template directory, renaming the original mHitech paypal1 first. And the same for paypal.xml from app/design/frontend/base/default/layout/paypal.xml into mHitech themes layout directory, renaming the original mHitech paypal1.xml first.  Thank you in advance.
